ORDER

The case came before the court on remand from the Supreme Court. There was a status conference today with David Montenegro and counsel for the City.

The parties agree the City has complied with the Supreme Court's ruling and disclosed to Mr. Montenegro the job titles of persons who monitor the City's surveillance equipment. Accordingly, the issues presented by the petition are resolved.

It appears under the circumstances that Montenegro is entitled to his costs. See ATV Watch v. N.H. Dept. of Resources & Econ. Dev., 155 N.H. 434, 439 (2007). Costs shall be determined by the clerk of court upon written request of Mr. Montenegro. See Super. Ct. R. 87. If Mr. Montenegro seeks costs other than the filing and service fees, the parties shall attempt to agree on what other [2] costs should be allowed.
