v.

Richard Poeleart, Robert Caron, Town of East Kingston

ORDER

A hearing occurred on December 11, 2008. The petitioner, David Pendell ("Pendell"), selectman of the Town of East Kingston, accuses Robert Caron ("Caron") and Richard Poeleart (whose name is actually "Poelaert"), also selectmen of the Town, of violating the right to know law, RSA 91-A, by "conducting town business outside of the public meetings." See Petition for Equitable Relief. Pendell seeks, among other things, "a cease and desist order in regards to change of deed for the Pound School in East Kingston." Id.

Upon full consideration of the evidence presented at the hearing, which included pertinent minutes, the Court concludes that the record does not support the conclusion that Caron and Poelaert conducted town business relative to the Pound School in violation of RSA 91-A.

Accordingly, the Court DENIES Pendell's request for relief and DISMISSES this case.

So ordered.
