PROPOSED ORDER

1. The late production of minutes of the May 20, 2008 was a technical violation of the Right-to-Know law but the delay was excusable under the facts and circumstances of this case.

2. The Petitioner, having appeared in this matter pro se is not entitled to the recovery of attorneys fees against any of the Respondents. He is, however, entitled to an award of costs.

3. The Portsmouth School Board is ordered to comply with the provisions of RSA 91-A by producing written minutes of all public meetings.
