THE STATE OF NEW HAMPSHIRE

ROCKINGHAM, SS SUPERIOR COURT

Christopher G. Merrill

v.

Town of Seabrook

97-E-0422

ORDER

This matter was the subject of a hearing before the undersigned on December 22, 1997 on plaintiff's Petition for Information under RSA 91-A as a result of which the court entered a preliminary order on December 24, 1997 (Doc.#6), wherein the defendant was ordered to furnish the court with documentation relating to certain litigation wherein Charles Felch was plaintiff and the Town of Seabrook was defendant for its in camera review.

The defendant having complied with that order, the court has conducted its review as a consequence of which the following order is entered.

The court finds and rules that the documentation relative to the details of the settlement with Charles Felch is, in effect, exempted from the operation of RSA 91-A by RSA 5-B:7. It is further found and ruled that, in the circumstances of that case, no municipal funds were utilized to settle the underlying action, nor were any actions of the Town or its representatives, including the Board of Selectmen, required to effect the settlement which was, in its entirety, handled by the New Hampshire Municipal Trust Association.

[2] Accordingly, the plaintiff's petition is DENIED.

So Ordered.
