ORDER ON PLAINTIFF'S
FOR INFORMATION UNDER RSA 91-A

The plaintiff, a resident of the Town of Seabrook, filed a petition under RSA 91-A seeking information from the Town of Seabrook relating to the settlement of a civil rights lawsuit instituted by Charles Felch against the Seabrook Police Department and the Town of Seabrook. The Town of Seabrook objects, arguing that RSA 5-B:7 prohibits the disclosure of the settlement agreement because it was negotiated and paid by the New Hampshire Municipal Association-Property Liability Trust and subject to a confidentiality agreement.

After a hearing on December 22, 1997 before the undersigned, the court orders that the Town of Seabrook furnish all documents in its possession relative to the Felch litigation and settlement agreement for an in camera review by the court. After the court's review, the court will issue an order as to what, if any, information must be provided to the plaintiff.
