ORDER FOR IN CAMERA REVIEW

On August 23, 2011, a hearing was calendared in the above-captioned matter to address the plaintiff's 91-A documentary request. In essence, the plaintiff seeks documentation of all action taken by the defendant New Hampshire Retirement System as such pertains to his disability application.

The defendant N.H.R.S., through counsel, has represented to the Court that it has produced all documents not confidential and excepted from production pursuant to RSA 91-A:5. The defendant asserts the attorney-client and work product privilege and/or documents "not in their final form" as justification for withholding "certain documents."

The defendant shall produce in camera for this Court's review all "confidential" records retained pertaining to this 91-A request. The Court will review said records within an additional ten (10) days and produce those, if any, that do not fall within the confidentiality exception.
