AN ACT revising the "Right to Know" law.

ANALYSIS

This bill makes the following changes to the "Right to Know" law:

1. It permits staff personnel of public bodies or agencies to attend executive sessions but prohibits them from participating in any deliberations conducted at such sessions.

2. It requires public bodies or agencies to keep minutes of executive sessions which must be available to the public at the termination of the session unless divulgence of the information would be likely to affect adversely the reputation of any person or impair the effectiveness of any action.

STATE OF NEW HAMPSHIRE

In the year of Our Lord one thousand nine hundred and seventy-seven

AN ACT

revising the "Right to Know" law.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Staff Personnel. Amend RSA 91-A:3 by inserting after paragraph II the following new paragraph:

III. Staff personnel or advisors of a body or agency holding an executive session may attend such executive session but may not serve as participants in deliberations held at the session. Any body or agency holding an executive session shall keep minutes of the session which must be available to the public at the termination of the session unless divulgence of the information would be likely to affect adversely the reputation of any person or impair the effectiveness of any action.

2 Effective Date. This act shall take effect 60 days after its passage.
