AN ACT relative to the right to know law.

ANALYSIS

The bill provides that any public official who refuses to provide a public document or access thereto to a citizen who requests same shall be personally liable for any attorney's fees incurred in making the information available provided the court does order such information to be given.

STATE OF NEW HAMPSHIRE

In the year of Our Lord one thousand nine hundred and seventy-three

AN ACT

relative to the right to know law.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Remedies Related to Access to Public Records. Amend RSA 91-A by inserting after section 7 the following new section:

91-A:8 Remedies. Any public official who, in violation of the provisions of this chapter, refuses to provide a public document or access thereto, to a citizen who requests the same, shall be personally liable for any attorney's fees incurred in making the information available provided the court does order such information to be made available to the citizen.

2 Effective Date. This act shall take effect sixty days after its passage.
